1. USING AN INDONESIAN NOMINEE
If an Indonesian citizen acts as nominee for foreign investors, there are number of contracts, and other document which must be prepared by, and signed in front of a qualified notary, it is for property transferring the right from the previous owner to the nominee, in any dispute regarding the property, given from the nominee to the investors.
2. USING A PMA COMPANY
If the foreigner have found the above arrangement to work satisfactory without any problems ( as long as all agreements have been properly executed in front of qualified notary), they must prefer to have their property owned by a PMA, before the establishment of a PMA company they must made Investment coordination board for approval of the company and it’s investment project, this approval is usually received after two or there months in the front of “ Capital Investment Approval Letter” freehold land is transferred to a corporate entity the title (Hak Milik/ freehold) whenever freehold land is transferred to corporate entity the title is changed to HGB which has to be renewed after 30 years.
